On April 22, 2021, the Environmental Protection Commission (EPC) staff will conduct a public workshop regarding proposed rule revisions to Chapter V of the "Basis of Review for Authorization of Activities Pursuant to Chapter 1-11 - Wetlands" (BOR). Chapter V deals with the Miscellaneous Activities in Wetlands (MAIW) permitting program. MAIWs are wetland permits for development which is of nominal consequence to the wetland and do not require a reasonable use analysis or mitigation. All other chapters of the BOR are not subject to revision. The purpose of the proposed rule revision is to clarify existing MAIW permitting criteria regarding construction and non- construction related activities such as boardwalks, docks, rip rap, other shoreline activities, and whole lake treatment. The proposed rule will be presented to the Commissioners for consideration in May or soon thereafter.
