On April 14, 2022, the Environmental Protection Commission (EPC) staff will conduct a public workshop regarding proposed rule revisions to Chapter V of the "Basis of Review for Authorization of Activities Pursuant to Chapter 1-11 - Wetlands" (BOR) and Section 1-6.05, Rules of the EPC. Chapter V deals with the Miscellaneous Activities in Wetlands (MAIW) permitting program. MAIWs are wetland permits for development which is of nominal consequence to the wetland and do not require a reasonable use analysis or mitigation. All other chapters of the BOR are not subject to revision. The purpose of the proposed rule revision is to clarify MAIW permitting criteria regarding aquatic plant control, vegetation removal, marginal structures, and exemptions. The proposed rule will be presented to the Commissioners for consideration in May.

EPC Rules only become final after a public hearing conducted by the Commission, which is anticipated to be held on May 19, 2022.
